This is an Agreement between Michigan Senior Living Consultants LLC (further referred to as MSLC) and the client (individual, family and/or entity requesting placement assistance). This agreement is effective immediately with acknowledgment of this Disclosure. MSLC refers clients to senior communities and care options, and is therefore in subjection to MICHIGAN PENAL CODE, CHAPTER 750, CHAPTER XXA VULNERABLE ADULTS under the State of Michigan’s Penal Code Act 328 of 1931.
MSLC provides personalized services to clients, their family members, or legal representatives who are looking for professional services in locating the proper senior community and/or care options. The relationship is at-will, and the client may terminate the relationship with written notice at any time. MSLC will retain the right to collect a referral fee from the referred senior community if the client enters an agreement with said community for a period of six months (180 days) following termination. MSLC makes referrals to Independent Living, Assisted Living, Memory Care, Long Term Care and Adult Family Homes options. The referrals are based on information from the intake form and client history which includes health history, personal preference, care needs, and financial abilities. Intake form information is covered by HIPAA healthcare information confidentiality law. This document will act as a medical release authorization and will only be shared with providers related to admission and or care services.
MSLC will refer only to facilities that have been through a vetting process and contracted. The Senior Community / Care Provider is required per contract to update MSLC regularly on the status of their facility license and state inspections outcomes. MSLC is not considered a provider and will not be liable or responsible for the acts or omissions of a housing and/or care provider. MSLC clients will not be asked to sign waivers of potential liability for losses of potential property or injury or to sign waivers of any rights of clients established by state or federal laws.
MSLC represents both the Client and the Senior Community / Care Provider. The Senior Community / Care Provider pays MSLC a referral fee for clients that choose to use their services. Referral fees are charged according to individual contracted terms with the Senior Community / Care Provider and are due from providers after the client takes financial responsibility. Referral fees cannot be passed onto the client. This is stated in the contract MSLC has with the Senior Community / Care Provider.
MSLC Agency Agreement
By entering into this agreement I appoint MSLC to represent us in the search for long-term care, housing, and services. This agreement creates an agency relationship with MSLC and the Client. This agreement supersedes any and all other agreements made with other placement service providers that might have been implied verbally, in writing, or with an internet search.
Terms
This agreement will expire at the time of the client’s acceptance of 3rd party services or by written notice. Clients shall be under no obligation to MSLC except for those obligations existing at the time of termination or completion of securing long term care and/or housing.
Warranties
MSLC makes no warranties or representation regarding the suitability or care of any referrals to a Senior Community / Care Provider. The client agrees to be responsible for conducting all investigations necessary to satisfy the suitability of said services.
Fees
Placement and referral services are free to all seniors and their families. Additional consulting services are available for clients at their request for $150/hr.
Onboarding
If the option to participate in MSLC’s onboarding program is elected, the terms shall continue after acceptance of 3rd party services. With the election to receive onboarding services a separate service agreement shall bind that agreement which is subject to MSLC service charges.
